Privacy Policy

The information required from you to obtain a Membership account and a Payday Advance is used only for the purpose intended. WE DO NOT DISCLOSE ANY NON-PUBLIC PERSONAL INFORMATION ABOUT OUR CUSTOMERS TO ANYONE, EXCEPT AS PROVIDED BY LAW.
PayDayHawaii and its' agents use the information for the following purposes only:
  1. To verify the information directly with your employer or income source and your bank.
  2. To confirm your identity through TeleTrack™
  3. To transfer funds to and from your bank through Bankoh SurePay™ ACH Service and ACH Commerce.
  4. To maintain a permanent record of your account so that you may obtain future Payday Advances.
  5. To transfer information online through Hawaiiantel Internet Services™.
  6. To send you information from time to time on the status of your account and changes in our policies or services.
All information you supply is confidential. We do not share or sell customer lists or information with any other individuals or businesses other than those listed above, and then only for the express purpose of processing and maintaining your PayDayHawaii Membership Account.

Disclosure

Posting and notice of fees charged for online service:
  • MEMBERSHIP ACCOUNT FEE…………….....FREE
  • PAYDAY ADVANCE FEE……15% (plus 4% Hawaii State GET) of the face amount of the check*.
  • NOTICE TO CONSUMERS: Consumer complaints about the check cashing business may be filed with the Department of Commerce and Consumer Affairs. The telephone number of the consumer information service of the Department of Commerce and Consumer Affairs is 587-3222.
*"Check," means any check, draft, money order, or other instrument for the transmission or payment of money.

Code of Conduct for Payday Advances (deferred deposit transactions):

  1. Full disclosure. FSPoH Association Members will comply with all Hawaii State and Federal disclosure requirements. Members will fully disclose to the customer all details of the payday advance transaction. A contract between a Member and the customer must fully outline the terms of the payday advance transaction. Association Members agree to disclose the cost of the service fee both as dollar amount and as an annual percentage rate (APR).
  2. Compliance. FSPoH Association Members will comply with all applicable laws. A Member will not charge a fee or rate for a payday advance not authorized by Hawaii State or Federal Law.
  3. Truthful advertising. FSPoH Association Members will not advertise the payday advance service in any false, misleading, or deceptive manner. We support as a guideline for truthful advertising regulations contained in the Federal Truth-in-Lending Act.
  4. Right to rescind. FSPoH Association Members will give its customers the right to rescind, at no cost, a payday advance transaction on or before the close of the following business day.
  5. Appropriate collection practices. FSPoH Association Members will only use legally authorized methods to collect sums that are due. No excessive or punitive late charges will be imposed. Association Members will seek only the recovery of the costs of collection and the timely repayment of the obligation. FSPoH Association Members will never threaten to file criminal charges against a customer merely for defaulting on a debt. Criminal charges are only appropriate where a customer seeks to defraud an FSPoH Member, such as by closing their checking account or passing a false instrument.
  6. Encourage consumer responsibility. FSPoH Association Members will implement procedures to inform customers of the intended use of the payday advance service. These procedures will include notifying customers that a payday advance is a short-tem cash flow tool not designed as a solution for longer-term financial problems and informing customers of the availability of credit counseling services.
  7. Financial literacy. FSPoH Association Members support financial education about all Member services, including payday advances. Association Members will strive to educate customers about the proper use of credit, household budgeting, the importance of saving and the proper use of banking services.
  8. Self-policing of the Association. FSPoH Association Members support self monitoring and are prepared to take action, including expulsion, against any of its Association Members who do not follow this code or fail to uphold the applicable legal standards in dealing with the public. FSPoH Association Members are required to operate within the law and continually educate their employees on changes in the law.
  9. Support balanced legislation. FSPoH Association Members will work with Hawaii State legislators and regulators to support responsible legislation of payday advances that incorporates this code of conduct. FSPoH Association Members support legislation to discourage pyramiding of advances and eliminating the cycle of debt.
  10. Military. FSPoH Association Members recognize the unique circumstances of active duty military customers and their dependants. Association Members will not garnish military wages or salaries; will not contact the military chain of command to collect payment; and will defer collection activity against a military customer that has been deployed to a combat or combat support posting for the duration of the deployment or a Reserve or National Guard member unexpectedly called to active duty.
The FSPoH Code of Conduct is based on the Consumer Financial Services Association Best Practices for the Industry with specific provisions for the State of Hawaii.
